Ada test drive terms
The terms of the free test drive without an account: what it covers, its limits, which websites may be indicated, how the phone call works and how to end the test drive.

1. Service provider and scope
- The service provider is Daniel Możdżyński, a sole trader operating as MH Daniel Możdżyński, ul. Sędziwoja 49 lok. 3, 61-063 Poznań, Poland, tax number (NIP) 8522140767, statistical number (REGON) 811228847, entered in the Polish Central Register and Information on Business Activity (CEIDG). Contact: contact@aivatary.com or post to the registered address.
- These terms set out the conditions for using the Ada test drive on the "Try Ada on your own website" page and are the terms of this service within the meaning of Article 8 of the Polish Act on Providing Services by Electronic Means. We make them available free of charge before the test drive is started, in a form allowing them to be obtained, reproduced and stored.
- The test drive is a separate service. It is not the Trial period within the meaning of the Terms of service, it requires no account and it does not change the Terms of service or the contracts concluded under them. A panel account and the widget on your own website are governed by the Terms of service.
2. Definitions
- Test drive
- A free, one-off demonstration in which Ada answers questions on the basis of the content of the Indicated website.
- Visitor
- The person who starts the Test drive.
- Indicated website
- The website whose address the Visitor enters in the Test drive form.
- Ada
- An assistant based on artificial intelligence, who holds the conversation in the chat window or by phone.
- Phone call
- A single automated call placed by Ada to the number given and confirmed by the Visitor.
3. What the Test drive involves
- Once the address of the Indicated website is given, we scan up to 25 of its public pages, respecting robots.txt and skipping pages whose address points to content about people. We publish the fetched content automatically, without human editing, as Ada's knowledge for the duration of the Test drive.
- Ada answers in the chat window on this site only on the basis of that content, so she may repeat a mistake or outdated information from the Indicated website. Her answers demonstrate how the service works and are not information given on behalf of the company that owns the Indicated website.
- In the Test drive Ada books nothing, records no requests and does not pass the conversation to a person. She says what she would do in the full version.
- When the phone is available, the Visitor may order one Phone call. It requires giving a mobile phone number from a country available in the form, consenting to the call and confirming the number with an SMS code. The call lasts about five minutes and never more than six. Ada opens it by saying that she is an assistant based on artificial intelligence, that the call is a demonstration of AIvatary using the Indicated website as an example rather than a call on behalf of that company, and that the call is transcribed as text.
- If the Visitor gives an email address, we send the transcript of the Phone call to it.
- The Test drive is free of charge and involves no subscription and no obligation to buy.
4. Technical requirements
- The Test drive requires a device with internet access and an up-to-date browser supporting JavaScript and session storage.
- The Indicated website must be publicly available without logging in. A website whose content is only built in the browser, or one protected against automated fetching, may not be possible to scan; the Test drive then ends with a message stating the reason.
- The Phone call requires a mobile phone that receives SMS messages, with a number from a country available in the form.
5. Start and end
- The contract for the Test drive is concluded when it is started with the button in the form. Before it is started, the form points to these terms.
- The Test drive lasts until the Visitor deletes it with the "End the test drive and delete its content" button, at most 7 days from the start. After that we delete it automatically, which ends the contract.
- The Visitor may end the Test drive at any time, without giving reasons and at no cost. The call can be cancelled before it is placed with the "Cancel the call" button, and the Phone call can be ended at any time by hanging up.
- We may refuse to start the Test drive or end it early if the Visitor breaches section 7, if the security of the service requires it or if the Test drive is switched off. A message on the test drive page says so.
6. Limits
- One Indicated website can have one Test drive within 30 days, and at most three Test drives can be started from one IP address within a day.
- Within one Test drive the chat window can be opened at most three times; the length of a single conversation and the number of questions per day are limited.
- One phone number can receive one Phone call within 90 days. We send an SMS code to one number at most twice an hour, and a code expires after 10 minutes. After no answer or a busy line we call again only at the Visitor's separate request, at most once and within 15 minutes of the previous attempt.
- In addition, we apply daily limits for the whole service and hold at most one Phone call at a time. Once they are used up, the Test drive or the phone is temporarily unavailable, as a message on the page explains.
7. Rules for indicating a website and prohibited conduct
- The Visitor may indicate only a website they are entitled to use in this demonstration, in particular the website of the company they represent or for which they are preparing a deployment. By starting the Test drive, the Visitor makes that declaration.
- It is prohibited to indicate websites with unlawful content, to use the Test drive to impersonate the company that owns the Indicated website towards third parties, and to attempt to circumvent the safeguards and limits.
- Special categories of data, such as health data, and other people's data should not be given in the conversation. The safeguards of the service do not release the Visitor from this rule.
- Only a phone number that the Visitor uses and on which the Visitor wants to receive the Phone call may be given.
- The Test drive is for adults.
8. Personal data
- How data is processed in the Test drive, including retention periods and recipients, is described in Part III of the privacy policy.
- Consent to the Phone call covers only this one demonstration and does not cover any later marketing calls.
9. Liability
- The Test drive is a demonstration. We do not undertake that Ada's answers will be complete and correct, because they rely solely on the content of the Indicated website fetched without editing.
- Ada's answers are not legal, medical or financial advice, nor information given on behalf of the company that owns the Indicated website.
- This section does not limit liability that cannot be excluded or limited under mandatory law, in particular towards consumers.
10. Complaints
- A complaint can be submitted by email to contact@aivatary.com or by post to the registered address.
- A complaint should describe the problem, the date it occurred and the address of the Indicated website.
- We consider the complaint and reply within 14 days of receiving it. For a consumer and for a sole trader with consumer rights, no reply within that period means the complaint is accepted.
11. Security
- Using services provided by electronic means carries typical risks, such as malware or attempts to phish for data. We recommend an up-to-date browser and caution towards messages impersonating us.
- In the Test drive we do not ask for passwords or payment card details. The SMS code serves only to confirm the number in this test drive and should not be passed to anyone.
12. Changes and final provisions
- We may change these terms for important reasons, in particular changes in the law or in the scope of the service. A change applies to Test drives started after it takes effect; a Test drive running on the day of the change ends under the previous terms.
- Matters not covered here are governed by Polish law. The choice of Polish law does not deprive a consumer of the protection of the mandatory provisions of the law of the country of their habitual residence.
- A consumer may use out-of-court complaint and redress procedures, including the help of a district consumer ombudsman. Using them is voluntary and requires the consent of both parties.
- These terms take effect on the date shown at the top of the document.
